Summary of November 4, 2008 Initiative # 07-0075

                         “The Three Strikes Reform Act of 2008”

To receive a Third Strike sentence of 25 years to life, a crime would have to be serious or violent.

Persons serving time for a 2nd Strike offense will not be eligible for re-sentencing

Persons whose 3rd strikes are nonviolent and non-serious will be eligible for re-sentencing. They will be re-sentenced at
twice the term otherwise provided for their particular offense, rather than the minimum of 25 years to life sentence they
are currently serving.  

Persons whose 3rd strikes are non-serious/nonviolent will not be eligible for
re-sentencing if:
        The person’s prior offenses include murder, rape or child molestation.
        The current offense includes major drug trafficking with 1kg. Plus (2.2 lbs or more),  or the manufacture,
compounding, producing, conversion of 1 lb. or more of controlled substances.
        The current offense is a felony sex offense requiring registration.

In the commission of the current offense the person:
        was armed with a firearm or deadly weapon
        used  a firearm or deadly weapon
        committed an act intended to cause great bodily harm or injury

At the time of re-sentencing the District Attorney will have the authority to review the case of anyone that s/he considers,
and can prove by a “preponderance of evidence”, to be an unacceptable danger to the safety of others.  The judge will
make the final decision regarding re- sentencing If the 3rd Striker is denied re-sentencing, s/he can re-apply for another
hearing in three years.

Re sentence - Length of terms:
All 3-Strikers who are re-sentenced will receive twice the term otherwise provided for their particular offense, rather than
the minimum of 25 years to life sentence they are currently serving.  

The “The Three-Strikes Reform Act of 2008” will be voted on November 2008 and will become effective on January 1,
2009.

supporting a California initiatives titled "The Three
Strikes Reform Act of 2008".

There are no clubs to join, meetings to attend or dues
to pay.  Although donations are encouraged!   It is our
intent to present factual information, current news,
and a secure means to contribute financial support.

100% of the funds raised on this site will be used to
finance the campaign to have our initiative become
law.  No salaries, office rent, or utilities will be paid.
No office equipment or  supplies will be purchased
with funds raised on this site!

The time is
now  to reform the California Three Strikes
law to what the
People had intended when passing
this law in 1994.   With our initiative, a sentence of 25
years to Life would be given to third strike felons with
a
serious or violent crime.  Not a non-serious /
non-violent
 crime.
Sentences that are now given to the non-serious/non-violent are cruel and unjust.  California
tax payers are shouldering a huge burden, of billions of dollars, for a system that is close to
imploding!  Meanwhile, other issues like education and health care  are in desperate need of
funds.

On this site we have made available reports and studies, written by experts, that
substantiate the need and wisdom of  redefining the current three strikes law.

The reform we purpose
will not  affect the integrity of the law as it was "presented" to the
people in 1994!
